3. DESCRIPTION OF SERVICES PROVIDED
The purpose of the www.mtggrade.com website is to provide information about all the company’s activities, to enable customers to place orders for services provided by the company, and to provide a customer account enabling customers to track their orders, consult their order history and access various information.
The site owner strives to provide information on the www.mtggrade.com site that is as accurate as possible. However, it cannot be held responsible for any omissions, inaccuracies or lack of updating, whether caused by itself or by third-party partners supplying the information.
All information provided on the www.mtggrade.com website is given for information purposes only, is not exhaustive, and is subject to change. They are given subject to any changes that may have been made since they were put online.
4. CUSTOMER ACCEPTANCE
The Customer’s acceptance is evidenced by his electronic signature, by clicking on the checkbox preceding the words “I have read and accept the terms and conditions of sale”, and by providing his bank details or PayPal account when paying for his order. This electronic signature has the value of a handwritten signature. For the Customer, this double step is equivalent to entering into the contract and acknowledging that he/she has fully understood and approves all the General Terms and Conditions that he/she has consulted.
5. CUSTOMER OBLIGATIONS
The Service Provider’s offer is intended for Internet users who are of legal age or who are emancipated minors. Any minor not emancipated or incapable of age must be assisted by a capable person in the sense of the law. The Customer declares and guarantees that:
- All registration information is accurate;
- All required fields contain true, accurate, complete and current information;
- None of the collector cards he/she is seeking to certify are counterfeit;
- The cards will be sent protected in accordance with the instructions given in the order confirmation e-mail. That he/she accepts the MTG Grade scale; and that he/she will not contest the grade obtained if he/she is not satisfied with it, as this grade results from the strict application of the grade scale, which he/she has previously accepted. MTG Grade returns sleeves and top loaders supplied by the customer, but reserves the right not to return sleeves weighing more than 40 grams (such as Ultimate Guard cases) or which are too bulky (tin box, Deck case, etc.).
- That it accepts the MTG Grade grading scale; and that it will not contest the grade obtained if it is not to its liking, this grade being the result of the strict application of the grading scale which he has previously accepted
- Once the order has been placed and paid for, the Customer has a period of 90 days to send the cards by post or by hand to MTG Grade. After this period, MTG Grade reserves the right to cancel the order and not to reimburse the Customer if the latter so requests.
Offers are valid while stocks last and subject to the proper functioning of the tools required for marking and sealing the protections.
The Service Provider reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order. Any order implies acceptance of the prices and descriptions of the items available for sale. Payment for services takes place once the order summary has been validated. Payment is made exclusively by Paypal, CB bank card, Visa, Mastercard, bank transfer for customers residing in France. Additional payment methods such as Bancontact, iDeal, etc. may also be offered to customers from other countries. The order will only be validated once the customer’s Paypal or bank details have been verified and authorization to debit your credit card has been received. For payments by bank transfer, it may take several days for the funds to be transferred. Without such authorization, the service cannot be provided.
Payment is made via a secure platform called Stripe (www.stripe.com). No bank details are stored by the Payment Service Provider. Once payment has been made, the Customer receives an order summary e-mail which formalizes the contract between the parties. In the event of cancellation after the cards have been dispatched, the customer will be liable for the cost of returning the cards, and any additional insurance costs will not be reimbursed. Once the cards have been certified and graded (or only certified for customers who have not selected the grading option), it becomes impossible to cancel the order, whether or not the cards have been sealed in a box, as the service has been provided by MTG Grade.
The cards are transported in two ways:
when they are sent by the Customer to the Service Provider and when they are returned by the Service Provider to the Customer. The Service Provider cannot be held responsible for any loss of parcel. In the event of non-receipt, the Service Provider will contact the carrier and inform the Customer, and the carrier will either compensate MTG Grade or not, and MTG Grade will refund the insurance premium to the Customer, based on the value covered. Shipping costs are at the customer’s expense, unless otherwise specified or hand-delivered.
6. RATES
The prices of the services provided by the Service Provider are shown on www.mtggrade.com, the MTG Grade website. They are expressed in Euros, all taxes included. These prices are subject to change at any time: modifications will only apply to future orders. Current orders are therefore not affected by these changes. The cost of preparation/logistics/transport of MTG Grade protections sold is indicated on the summary page of the customer’s order, before final validation of the purchase. Price reductions granted by the Service Provider may be revised at any time.
7. NON-COMPLIANCE
In the event that the licenses of the cards to be certified sent by the Customer are different from those mentioned in the order, the Service Provider shall be entitled to propose to the Customer to modify the order to bring it into line with the cards received. n additional charge or a price reduction may be requested. If the customer refuses, the cards will be returned to him/her and shipping costs will be charged at the current rate (La Poste Colissimo).
The Provider is not responsible for any damage to the MTG Grade protections after they have been sent. As mentioned above, the Service Provider will not reimburse the cost of services for cards that it has judged to be false, as the detection of a false card is the subject of the Service Provider’s authentication expertise. The Service Provider will issue a “certificate of non-authenticity” to the Customer, which may be used by the Customer to assert any rights to reimbursement if he has purchased his cards from a sales platform.
The Service Provider is not liable for any damage to the sealed cards in the event that the MTG Grade protections are broken or damaged during transport or after receipt by the Customer. In accordance with legal provisions, the Service Provider guarantees the Customer against any lack of conformity of the services and any latent defect resulting from a design or manufacturing fault in the services supplied, making them unsuitable for the use for which they were intended.
In case of major non-conformity, the Customer must notify the Provider and return the non-conforming protections (damaged item, damaged package …) to the Provider’s Customer Service, within 24 hours of their receipt according to the terms and conditions referred to in the Article the Provider will make its best efforts to deliver to the Customer the conform product within thirty (30) days. If the Customer fails to do so, the Provider shall refund the purchase price.
After this 24-hour period, claims for non-conforming delivery will no longer be admissible and the Provider will not be required to make a new delivery. In case of abnormal or abusive returns, the Provider refuses to serve a subsequent order. The Customer declares and accepts that the notation cannot be a source of non-conformity.
The Provider shall use its best efforts to deliver to the Customer compliant protections, as defined by the provisions of L 211-4 and L 211-5 of the French Consumer Code. However, the Provider cannot prevent a possible non-conforming delivery.
8. Autographed card
MTG Grade will give a “Signed” status to authentic autographed cards.
MTG Grade differentiates between autographs made by sportsmen and women, artists and illustrators certified by the card publisher, and autographs made by sportsmen and women, artists and illustrators in other contexts (events, conventions, sporting events, etc.).
The note and authenticity given relate only to the card and not to the autograph. The Society will authenticate only the card on which the autograph is made and not the autograph itself. MTG Grade will include a “Signed – Verified” entry in its online database when the customer has provided sufficient proof (certificate, photo, admission ticket, etc.) and the signature analysis has confirmed the authenticity of the signature.
9. INTELLECTUAL PROPERTY AND COUNTERFEITING
The owner of the site is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logo, icons, sounds, software…
Any reproduction, representation, modification, publication, total or partial adaptation of the elements of the site, whatever the means or the process used, is forbidden, except prior written authorization to the email : contact@mtggrade.com
